myUmeken Loyalty Program - Terms and Conditions

Welcome to the myUmeken Loyalty Program (the “Program”), a customer rewards program designed to thank you for your loyalty to Umeken. By enrolling in and participating in the Program, you agree to the following Terms and Conditions. Please read these Terms carefully.

1. General Overview
  • 1.1 The Program is operated by Umeken USA, Inc. ("Umeken" or "Company") and is available to customers who register for the Program.

  • 1.2 Enrollment in the Program is free, and participation is voluntary.

  • 1.3 These Terms and Conditions apply to all participants and govern the earning and redemption of points, tier statuses, and rewards.

  • 1.4 Binding Agreement: By participating in the Program, you agree to be bound by these Terms. Umeken may update or terminate the Terms and the Program at its sole discretion.

2. Membership Enrollment
  • 2.1 Eligibility: Membership is open to individual U.S. or Canada residents at least 18 years of age. Resellers are excluded from the Program.

  • 2.2 Registration Requirements: To join, you must provide your name, phone number, and address or email during the enrollment process.

  • 2.3 Membership Fee: No membership fees are required.

  • 2.4 Consent to Communications:

    • By enrolling in the Program, you agree to receive communications from Umeken, including phone calls, SMS text messages, email updates, and other forms of communication related to the Program, promotional offers, and customer service.
      • ° Opt-Out: You may opt out of promotional communications at any time by following the opt-out instructions provided in such communications or contacting us directly. However, essential communications related to your account and membership (e.g., point status or expiration notices) cannot be opted out of.
      • ° Standard Rates Apply: Standard messaging, data, and phone rates may apply based on your carrier’s plan. Umeken is not responsible for any fees charged by your carrier.

  • 2.5 Prohibited Activities: Use of the Program for commercial or fraudulent purposes is strictly prohibited and may result in immediate termination of membership.

3. Membership Tiers
  • 3.1 Tier Structure:

    • The Program includes four tiers: Gold, Platinum, Diamond, and Black.
    • Tiers are determined based on the total qualified spending amount in a calendar year:

    Gold

    $1 – $1,000

    Platinum

    $1,001 – $2,500

    Diamond

    $2,501 – $5,000

    Black

    $5,001 and above

  • 3.2 Qualified Spending:

    • Qualified spending refers to the amount paid by the customer, excluding shipping, taxes, and other fees.
    • Qualified spending is reset at the beginning of each calendar year.
  • 3.3 Tier Validity:

    • Tier status earned during the calendar year is valid until December 31 of the following year.
    • Members who start the calendar year with a status must meet the spending threshold during the calendar year to maintain that status for the subsequent year.
4. Earning and Redeeming Points
  • 4.1 Earning Points:

    • Qualified Purchases: Points are earned on the total purchase amount paid by the customer after applying any discounts or coupons but excluding taxes, shipping, and other fees.
    • Standard Earning Rates: Points are earned at different rates depending on the membership tier:

    Gold

    10 points per $1 spent.

    Platinum

    15 points per $1 spent.

    Diamond

    20 points per $1 spent.

    Black

    30 points per $1 spent.

    • Extra Points Opportunities: Points can also be earned through specific promotions such as:
      • ° Product-specific promotions.
      • ° Bonuses for spending milestones.
      • ° Referral bonuses when new customers join and make purchases using your referral link.
      • ° Sign-up bonuses for new members.
    • Pending Points: Points earned will initially appear as “pending” and become available for use 7 business days after purchase completion. Pending points are subject to order verification.
    • Exclusions: Points will not be earned on purchases made during designated blackout periods (e.g., special promotions or clearance sales, as announced by Umeken).
  • 4.2 Redeeming Points:

    • Redemption Value: Points may be redeemed for products or cash credits as follows:
      • ° To redeem points as cash credits, a minimum of 7,000 points ($10 equivalent) is required per transaction. Once the minimum is met, points can be redeemed in increments of 700 points ($1 equivalent) in the same transaction.
      • ° Points can also be used to purchase items based on the redemption chart. For example:
      • - Product A (MSRP: $10) requires 4,000 points.
      • - Product B (MSRP: $98) requires 42,000 points.
    • Minimum Redemption Threshold: A minimum of 7,000 points is required to redeem cash credits toward purchases.
    • Redemption Limitations:
      • ° Not all products are eligible for purchase with points. Restricted products will be noted on the redemption chart or product page.
      • ° Points cannot be applied to taxes, shipping fees, or other non-product charges.
      • ° Blackout periods may apply for redemptions (e.g., during major sale events or peak seasons).
    • Expiration of Points: Points remain valid for the year they are earned plus an additional three (3) years. For example, points earned in 2025 will expire on December 31, 2028.
  • 4.3 Redemption Process:

    • Members can redeem points via:
      • ° Online at Umeken.com.
      • ° Customer service center.
      • ° Umeken corporate stores.
    • Members must ensure sufficient points in their account at the time of redemption. Partial redemptions (e.g., points + cash) may be allowed for eligible products.
  • 4.4 Refunds and Adjustments:

    • Refunds for Purchases Made with Points:
      • ° If a product purchased with points is returned, the points used for the purchase will be refunded to the member’s account, subject to Umeken’s return policy.

      • ° No cash refunds will be issued for redeemed points.
    • Mixed Payments: If a transaction involved both points and cash, refunds will be issued in the original payment method(s) used:
      • ° Points will be credited back to the account.
      • ° Cash refunds will be processed to the original payment method.
    • Order Adjustments: If a purchase is refunded, canceled, or adjusted, points earned from that transaction will be deducted from the member’s account.
  • 4.5 Fraud Prevention and Account Monitoring:

    • Fraudulent Activities: Members must not engage in fraudulent, dishonest, or abusive behavior to earn or redeem points. Examples of prohibited actions include, but are not limited to:
      • ° Creating multiple accounts to manipulate the system.
      • ° Making returns after redeeming points earned on the purchase.
      • ° Using points in ways not authorized under these Terms.
    • Account Suspension or Termination:
      • ° If fraudulent activity is detected, Umeken reserves the right to suspend or permanently terminate a member's account and forfeit all associated points, rewards, or benefits.
      • ° Members will be notified of the suspension or termination, along with an explanation of the violation.
    • System Audits: Umeken may perform periodic audits of member accounts and transactions to ensure compliance with the Program’s terms.
5. Coupons and Gifts
  • 5.1 Coupons:

    • Members receive quarterly coupons based on their tier. Each member receives one coupon per quarter, totaling four coupons per year. The coupon amounts are as follows:

    Gold

    $10 per quarter (4 coupons per year)

    Platinum

    $15 per quarter (4 coupons per year)

    Diamond

    $20 per quarter (4 coupons per year)

    Black

    $30 per quarter (4 coupons per year)

  • Coupons are issued at the start of each quarter and expire at the end of that quarter (e.g., March 31, June 30, etc.).
  • A minimum purchase of $75 is required to use the coupons, and coupons can be combined with other offers.
  • 5.2 Annual and Anniversary Gifts:

    • Annual gifts are available for Diamond and Black tiers only.
    • Anniversary gifts are exclusive to Black-tier members.
6. Program Modifications and Termination
  • 6.1 Changes to the Program: Umeken reserves the right to modify or terminate the Program, including point structures, redemption values, tiers, and rewards, at any time without prior notice.

  • 6.2 Account Closure:

    • Members may terminate their membership at any time by contacting customer service.
    • Umeken reserves the right to cancel memberships for fraudulent activity, abuse of the Program, or inactivity.
7. Legal and Compliance Terms
  • 7.1 Non-Transferability: Points, tiers, and rewards are non-transferable, non-assignable, and may not be shared, sold, or bartered under any circumstances.

  • 7.2 Limitation of Liability:

    • IN ADDITION TO OTHER LIMITATIONS AND EXCLUSIONS IN UMEKEN TERMS AND CONDITIONS, IN NO EVENT WILL UMEKEN OR OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR OTHER REPRESENTATIVES BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, ARISING OUT OF OR RELATED TO THE PROGRAM. THESE EXCLUSIONS AND LIMITATIONS OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND WILL SURVIVE CANCELLATION OR TERMINATION OF YOUR MEMBERSHIP.
    • Umeken is not responsible for any errors or delays in the processing of points,rewards, or tier updates.
  • 7.3 Entire Agreement: These Terms constitute the entire agreement between the member and the Company regarding the Program and supersede all prior agreements,understandings, or representations.
